1.1 - Jurisdiction

The stipulations of these Terms and Conditions extend to all reservations pertaining to courses or events provided by Tec Training (GB) Ltd. In cases of conflicting terms and conditions, these provisions will take precedence unless Tec Training (GB) Ltd explicitly agrees otherwise in written form. Any alterations to these terms necessitate prior written approval from Tec Training (GB) Ltd. These contract terms will be construed in accordance with English law, and both parties’ consent to the jurisdiction of the country where the courses or events are conducted.

1.2 - Acceptance

Once a booking is placed or ordered through email, online, or by phone, the client/delegate acknowledges and accepts these contractual Terms & Conditions as binding. In such case, this supersedes the booking form, which serves solely to authorise the booking.

1.3 – Course/Assessment Bookings

When booking courses or events via email, online, or by phone, client purchase order numbers must be quoted on the Tec Training (GB) Ltd course booking form, or a client order form must be submitted at the time of booking if applicable. For all track safety courses, the course booking form (training authorisation) must be signed by the (Sponsor) company representative prior to the event commencing, failure to return the booking form prior to the event will result in the delegate being refused entry to the course/assessment. In such cases, the full course/assessment fee remains payable.

1.4 - Cancellation and Transfer of Bookings

Where clients cancel courses with less than 14 days’ notice, the course fee is payable in full. If a booking has been made within 14 days from the course start date, the client will not be eligible for any refunds or date changes. Substitution of a nominated delegate can be made free of charge up to 48 hours prior to the event-taking place (excluding LU-WSI Assessments, see clause 1.22). The nominated delegate can only be changed once, further charges will be applied for any additional changes.

Tec Training (GB) Ltd will endeavour to run all advertised and programmed events. However due to unforeseen circumstances it may be necessary to reschedule or cancel a particular event. In such cases Tec Training (GB) Ltd will not accept any consequential liability irrespective of notice given.

1.5 - Indemnity

The client shall indemnify and hold Tec Training (GB) Ltd harmless for any claim resulting from injury to persons and damage to third party property except as a direct result of the negligence of Tec Training (GB) Ltd or its employees. Tec Training (GB) Ltd shall not be liable for any financial, economic, or consequential losses of any kind that may be incurred by the client either directly or indirectly in the performance of the contract.

1.6 - Payment

For account clients, payment for courses/events must be made within the agreed date as specified on the credit application. If Tec Training (GB) Ltd cannot obtain credit clearance for a customer, course fees will be payable in advance. All fees are inclusive of VAT. Individuals that are funding courses for themselves will need to make full payment upon booking any training courseevent.

Details on how to make payments can be gained by contacting the Accounts Department at Tec Training (GB) Ltd. For any applicable refunds where payments have been made via Debit Card / Credit Card or BACS, a 5% transaction fee will be deducted from the payment.

1.7 - Certification and Course Allocation

Tec Training (GB) Ltd are not liable for any lost certificates/documents due to the postal service. Additional charges may apply to re-order certificates /documents. Once a delegate has been allocated a course date the client will not be eligible for a refund. Should a delegate fail to attend on time on their allocated course date, the delegate will not be permitted onto the course and full fee will be applied.

1.8 - Zero Tolerance

The use of profanity, verbal threats, or any act of violence will not be tolerated during the training event. If such behaviour occurs, the delegate will be promptly asked to leave the premises, and the client will be informed of the incident.

1.9 - Covid-19

Following changes in Government guidelines, should any delegates test positive for COVID-19, course bookings will be non-refundable and non-changeable and any outstanding payment/invoice will remain payable.

1.10 - Medical Screening

Delegates attending a Medical Screening who have been identified to have any form of medical condition or requires review from the Medical Review Officer will have one free review. Any further review by the Medical Review officer will be charged at £30.00 for each review, including any follow ups.

1.11 - Medical Requirements – All NR courses undertaken

It is a pre-course requirement for all Network Rail courses, unless specified, that delegates meet the minimum Network Rail medical fitness standard in NR/L2/OHS/00124 (Competence Specific Medical Fitness Requirements) and drugs/alcohol screening as required in specification GE/RT8070 Issue 2 (Testing Railway Safety Critical Workers for Drugs & Alcohol). Please note that a Network Rail approved provider must perform medical examinations. If a Medical and drugs/alcohol test is required, please contact the salesteam.

1.12 - Railway/Construction Courses

Delegate places are not confirmed and Joining Instructions will not be issued until Tec Training (GB) Ltd have received confirmation of payment from the delegate /company. Please allow 48 hours for bookings to be processed. If the event takes place in less than 14 days from the course start date, the company will not be eligible for any refunds or date changes and payment is nonrefundable. The booking system works on a first come first serve basis; Tec Training (GB) Ltd do not reserve or hold places until payment is made. The training team process bookings and queries Monday to Friday from 09:00 to 16:00.

1.13 – Pre-Requisites for Courses/Assessments

Delegates who fail to meet the pre-requisites on a course/assessment will be refused entry and will not be entitled to a refund, in this case, full fees will be payable. It is a mandatory requirement that all delegates attending any Sentinel Training, unless specified, must have a valid Medical and Drugs & Alcohol certificate on Sentinel and a valid Primary Sponsor.

1.14 – PTS/ICI E-learning

It is a course requirement for PTS/ICI that all delegates complete the necessary E-learning module prior to attending the course/assessment. Tec Training (GB) Ltd reserve the right to refuse acceptance of the delegate onto the course if delegates fail to complete the E-learning module or have not met the correct requirement for the event booked. In such cases, the full course/assessment fee remains payable.

1.15 - Personal Identification

Delegates attending any course/assessment must bring original and valid photo identification as well as any other documents that meet the requirements stipulated in the relevant course/assessment Joining Instructions. Failure to provide the required photo identification and/or documents, will result in refused entry. In such cases, the full course/assessment fee remains payable.

1.16 - Late Arrivals/Missed sessions

If a delegate arrives late for a course/event after the stipulated start time or is absent from any course/event sessions, the delegate will not be permitted to enter the course in any circumstance. In such cases, the invoice/payment will remain payable. Should the delegate or Sponsor wish to rebook the training event, full fees will apply.

1.17 - Unauthorised Recording

Tec Training (GB) Ltd do not authorise any use of recordings or cameras during exams and training. If a delegate is found in possession of any recordings / pictures once entered into the centre, it would be a breach of the terms of business and will be deemed liable for prosecution. Any recordings or pictures taken will be deemed as the property of Tec Training (GB) Ltd.

1.18 - CCTV Surveillance

The centre has 24-hour CCTV surveillance in operation. For personal safety and security, video linked security cameras maintain constant recorded surveillance of the premises. Video evidence can be used in a court of law. All activities are recorded to aid in the prosecution of any crime committed against the facility.

1.19 - Working Hours

All delegates attending any training event must ensure that they have not worked 12 hours prior to the training event in line with NR/L2/ERG/003.

1.20 - Work Experience Book (Logbooks)

Evidence of a learner’s work experience can only be accepted in the standardised work experience book or electronic logbook, where this is required and specified within course Joining Instructions. Any learner that attends for training on any recertification course requiring a logbook, and fails to bring the logbook, or does not meet the requirement stipulated in the Joining Instructions, will be refused entry. In such cases, the full course/assessment fee remains payable.

1.21 - Complaints

If a client/delegate has a complaint about any products or services provided by Tec Training (GB) Ltd, please get in contact via email or telephone 0207 476 1111. A manager will investigate the complaint and aim to provide a response within 10 working days, in line with Tec Training (GB) Ltd.’s complaints policy and procedure.

1.22 - LU-WSI Assessments

When booking LU-WSI assessments, Tec Training (GB) Ltd will upload the eLearning for the delegate and invoice the client. The client must book the assessment at the time of initial registration/booking. Once eLearning is uploaded, in no circumstances can the delegate be replaced or changed.
The LU-WSI eLearning is a mandatory prerequisite that must be completed by the delegate prior to the assessment, and the responsibility lies with the Sponsor to communicate this requirement to the delegate. The delegate must provide the required identification as outlined in the joining instructions as well as providing right-to-work documents in accordance with LU guidelines, as established by the (CPNI) and the Home Office UK Border Agency. The client must specify if they require a rebooking of the same individual when sending an email, failure to do so may result in being charged the full fee.

1.23 - Workplace Assessments/Events

When booking any workplace assessment/event, it is the Client's responsibility to ensure that the delegate(s) meet all the prerequisites as well as ensuring the mandated specific requirements set by Network Rail. The client must provide all the necessary details atleast 24 hours prior to the assessment/event, with the exception of same day booking, in which case we require all details atleast 12 hours prior. Once the booking is initiated, the Client cannot change the date or shift time of the assessment/event. We require atleast 48 hours’ notice if the location of the assessment/event requires changing, taking additional mileage cost into account. In such cases where the above is not adhered to, full fees remain payable.
